Terms of Use
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Service. By using the Service, you represent that you meet these requirements.
2. Account registration
You must register with a valid mobile number and email address. You are responsible for:
- Keeping your login credentials confidential.
- All activity that occurs under your account.
- Notifying us immediately at support@watsinfo.com if you suspect unauthorised access.
We reserve the right to suspend or terminate accounts that provide false or misleading registration information.
3. Permitted use
The Service is intended solely for landlords and property managers to manage their own residential or commercial properties, tenancies, and rent records in India. You agree to use the Service only for lawful purposes and in accordance with these Terms.
You must not:
- Use the Service to store or process data belonging to properties or tenants you do not have lawful authority to manage.
- Upload false, fabricated, or unlawfully obtained identity documents.
- Attempt to reverse-engineer, decompile, or extract the source code of the application.
- Use automated scripts, bots, or scrapers to access the Service.
- Interfere with or disrupt the servers or networks used to deliver the Service.
- Circumvent any security or access-control mechanisms.
4. Tenant data and your responsibilities
You may upload sensitive personal data about your tenants, including Aadhaar card images, photographs, and contact details. By doing so, you confirm that:
- You have obtained the tenant's consent to collect and store their personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act).
- You will use tenant data only for legitimate property-management purposes.
- You will not share tenant data obtained through the Service with unauthorised third parties.
We store sensitive files in encrypted form (AES-256-GCM) and restrict access to your account only. However, the legal responsibility for obtaining proper consent from your tenants rests with you.
5. Subscriptions and billing
The Service is offered under subscription plans. Billing will be activated in a future release. When billing is live, the following terms apply:
- Subscriptions are billed in advance for the chosen period (monthly or annual).
- You authorise us to charge the payment method on file for renewal unless you cancel before the renewal date.
- Refunds are not provided for partial billing periods, except where required by applicable Indian law.
- We may change subscription pricing with 30 days' notice. Continued use after the price change takes effect constitutes acceptance.
6. Intellectual property
All software, design, trademarks, and content comprising the Service are the exclusive property of Wats Infosystems Private Limited or its licensors. These Terms do not grant you any ownership rights. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the term of your subscription.
Your data (property records, tenant records, uploaded files) remains yours. We claim no ownership over content you create in the Service.
7. Availability and changes
We will make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may:
- Perform scheduled or emergency maintenance, with or without advance notice.
- Modify, add, or remove features at any time.
- Discontinue the Service with 60 days' notice, during which you can export your data.
8. Disclaimer of warranties
The Service is provided "as is" and "as available." To the fullest extent permitted by Indian law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will meet your specific requirements or that it is free of errors or security vulnerabilities.
9. Limitation of liability
To the maximum extent permitted by applicable law, Wats Infosystems Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service — including loss of data, loss of revenue, or business interruption — even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising from or related to the Service shall not exceed the total subscription fees you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Wats Infosystems Private Limited, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; or (c) your handling of tenant data without proper consent.
11. Termination
You may close your account at any time by contacting us at support@watsinfo.com. We may suspend or terminate your account immediately if we determine you have violated these Terms or applicable law. Upon termination, your access to the Service ends and your data will be deleted within 30 days, except where retention is required by law.
12. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India. We encourage you to contact us first to resolve any issue informally before initiating legal proceedings.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and notify active users via the app at least 14 days before the new Terms take effect. Your continued use of the Service after that date constitutes your acceptance of the revised Terms.
